HALLE BERRY TO GET RESTRAINING ORDER AGAINST GABRIEL AUBRY?
Aubry, who was arrested last Thursday after a physical altercation with Martinez outside Halle Berry's Hollywood home, submitted images showing the brutal injuries he sustained after his bust-up, including a swollen black eye, cuts and bruising around his other eye, forehead and nose and bloodied fingernails. He was hospitalised with broken ribs prior to his arrest.
According to Aubry, who obtained an emergency protective order against Martinez yesterday, at Nahla's school play the day before the bust-up, Halle's fiancé allegedly whispered in Aubry's ear in French:
'I wish I could beat the s*** out of you right now. You're lucky we're in a school right now. We're going to take Nahla right now and you're not going to follow us.'
Halle is embroiled in a bitter custody battle with her ex, who recently interfered with the actress's attempts to move her daughter to France.

Aubry also claimed that on the day of the fight, Martinez - atypically - answered the front door, saying: 'We need to talk,' before knocking Aubry to the ground and assaulting him, slamming his hand on the concrete driveway and screaming that 'they were going to move to Paris and Gabriel had better move there too or Olivier would kill him.'
Aubry also alleged that Olivier then said: 'We called the cops... you're going to tell them that you're the one who attacked me, or I'm going to kill you.'
Sources on Halle's side claim it was Aubry who lost his temper and started the brawl.
Aubry has also been slapped with a restraining order requiring him to stay 100 yards away from Halle, Nahla and Olivier, and new reports suggest the male model may be facing deportation back to Canada because of the arrest.
